Terms of Service

Introduction

These Terms of Service govern your use of garageqr.app and any related services we provide (collectively, "the Service"). By using the Service, you agree to these Terms. Effective date: 2026-05-15.

"We", "us", and "our" refer to Garage QR. "You" refers to you as a seller using the Service. If you don't agree with these Terms, don't use the Service.

The service

Garage QR lets you create listings with photos, print QR stickers to attach to physical items at your garage sale, and let buyers contact you directly by SMS. We don't process payments, hold funds, or act as an escrow. All buyer-seller transactions happen off-platform, between you and the buyer directly.

Buyers do not have accounts on garageqr.app. They scan your QR sticker, view your listing, and tap an SMS button to contact you. Everything after that is between you and them.

Seller accounts

To create listings you need a seller account. We support sign-in via Google OAuth and email magic link. You may only create one account per person. You're responsible for keeping your account secure and for everything that happens under your account.

You must be at least 18 years old to create an account. By creating an account you represent that you meet this requirement.

Acceptable use

The Service is for personal property sold at in-person, local garage sales. You may use it to list items you personally own and have the right to sell, to buyers who will collect those items in person.

You may not:

  • Use the Service for commercial resale businesses or drop-shipping
  • Create listings for items you don't own or don't have the right to sell
  • Misrepresent item condition, origin, or authenticity
  • Harass, threaten, or deceive buyers
  • Scrape, crawl, or otherwise collect data from the Service by automated means
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service in any way that violates applicable law

Prohibited items

You may not list the following items under any circumstances:

  • Firearms, weapons, ammunition, explosives, tasers, or pepper spray (applicable state and federal restrictions apply regardless)
  • Controlled substances, prescription drugs, or drug paraphernalia
  • Live animals or animal parts (including wildlife and wildlife products)
  • Flammable, toxic, corrosive, or radioactive materials
  • Products subject to an active CPSC recall
  • Stolen goods, items with removed or altered serial numbers, or items you don't have the legal right to sell
  • Adult or sexually explicit content
  • Counterfeit, pirated, or fraudulent items

We may remove listings and suspend accounts for prohibited items without notice.

Seller-buyer relationship

Garage QR is a platform only. We are not a party to any transaction between sellers and buyers. All sales occur off-platform, arranged directly between you and the buyer via SMS.

We make no guarantee about item condition, buyer legitimacy, or transaction completion. You are solely responsible for your listings, your communications with buyers, and any transactions you enter into. We have no role in, and no liability for, any dispute between you and a buyer.

Content and photos

You retain ownership of the photos and text you upload. By uploading content you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, modify (for technical purposes such as format conversion, resizing, and EXIF stripping), display, and serve it as needed to operate, provide, secure, and improve the Service. This license ends when you delete the listing or close your account, except for backup copies retained for a reasonable period and content already cached by third parties.

You warrant that you own the content you upload or have the right to use it, and that it doesn't infringe anyone else's rights. We'll remove content and suspend accounts for violations.

Photos and location data

Location data embedded in photos you upload is stripped before storage and never retained. iPhone and other camera photos often carry GPS coordinates accurate to meters. We strip this EXIF metadata automatically before your photo reaches our storage servers. We never log, store, or transmit your GPS location. Intellectual property

Garage QR, its logo, and the software powering the Service are our intellectual property. Nothing in these Terms grants you a right to use our trademarks, logos, or branding.

Limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising out of these Terms or the Service won't exceed the amounts you paid us in the twelve months before the claim arose, or one hundred U.S. dollars, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Garage QR and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your listings, photos, or other content you upload to the Service
  • Your communications or transactions with buyers
  • Items you sell or attempt to sell through the Service
  • Your violation of these Terms or applicable law
  • Your infringement of any third party's rights, including intellectual property rights

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

Account suspension

We may suspend or terminate your account if you:

  • Violate these Terms or our acceptable use policy
  • List prohibited items
  • Engage in fraudulent activity or deceive buyers
  • Attempt to abuse or circumvent the Service
  • Create multiple accounts

We'll try to notify you if we suspend your account, but we're not obligated to do so for serious violations. You can contact us at [email protected] to appeal a suspension.

Dispute resolution

If you have a dispute with us, please first email [email protected] to try to resolve it informally. We'll respond within a reasonable time and work in good faith to find a solution.

If informal resolution doesn't work, disputes may be brought in the state or federal courts located in California, or in small claims court if the claim qualifies. You agree to submit to personal jurisdiction in California for any such dispute.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

Changes

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted means you accept the updated Terms. If a change materially affects your rights, we'll make reasonable efforts to notify you — for example by updating the date prominently or by email if we have your address.
